GENERAL TERMS & CONDITIONS OF CONTRACTING AND CANCELLATION POLICY

These General Terms and Conditions govern the chartering and booking of vessels through the website mallorcaboatrentals.com, owned by Bellapart Patrimonio, SLU (NIF B07763766).

1. Pre-Contractual Information & Booking Process

Through the website, users can reserve the charter of the traditional Llaut “Poc a Poc”. During the booking process powered by our LatePoint system, the client selects the desired date, duration option (Full Day, Half Day, or Sunset Charter), and completes the payment via the secure Stripe gateway. The contract is finalized upon payment confirmation.

2. Exception to the Right of Withdrawal

In accordance with Article 103(l) of Spanish Royal Legislative Decree 1/2007 (TRLGDCU), the standard 14-day statutory right of withdrawal does NOT apply to our services. Because our bookings consist of leisure activities provided on a specific date or period of performance, charter reservations are exempt from statutory withdrawal and are exclusively governed by our Cancellation Policy outlined below.

4. Passenger Conduct & Safety Rules

Clients and guests agree to adhere strictly to the instructions provided by the skipper (Juan Manuel Tallada or Alejandro Bellapart) and use all aboard equipment responsibly (dinghy, paddle boards, snorkeling gear). The skipper reserves the right to terminate the navigation at any point without refund if passenger behavior compromises safety.

5. Governing Law and Jurisdiction

These conditions are governed by Spanish law. Any dispute arising from or related to the use of this website or contractual fulfillment shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of Palma de Mallorca, Balearic Islands, Spain (unless mandatory consumer protection laws dictate otherwise).
